JOB PURPOSE:

The Senior Counsel – Regulatory & Compliance is an experienced individual-contributor role that supports regulatory, compliance, and commercial legal work historically performed by outside counsel. This role requires sound legal judgment, strong issue-spotting, and the ability to operate effectively in a highly regulated healthcare environment, escalating higher-risk matters to the General Counsel as appropriate.

The Senior Counsel supports healthcare regulatory and compliance matters, internal investigations, and day-to-day commercial and corporate legal support for operating divisions and adjacency businesses. The role partners closely with the General Counsel and cross-functional stakeholders to deliver practical, defensible guidance and documentation, and does not have direct people-management responsibility.

The pay range for this position is $156,080-$214,610 salary. It is not typical for an individual to be hired at or near the top of the pay range and compensation decisions are dependent on the facts and circumstances of each case. The specific compensation offered to a candidate may be influenced by a variety of factors including skills, qualifications, experience and location.

KEY RESPONSIBILITIES:

§  Conduct internal compliance investigations, including government audits, payer reviews, whistleblower matters, and internal allegations of noncompliance, with responsibility for investigation strategy, documentation, findings, and remediation recommendations.

§  Evaluate and advise on fraud and abuse risk, including AntiKickback Statute and False Claims Act exposure, overpayment identification, repayment strategies, and disclosure considerations, in coordination with the General Counsel.

§  Provide legal support to the Numotion Compliance team on regulatory and compliance matters.

§  Provide day-to-day legal support to SpinLife, CorLife, and Numotion Medical Supplies, on corporate, commercial, and regulatory issues, coordinating with General Counsel on escalations and strategy.

§  Draft, review, and negotiate commercial agreements, including vendor, partner, and customer contracts supporting daytoday operations and initiatives.

§  Advise on licensing, accreditation, and enrollment matters, including Medicare enrollment, revalidation, change of ownership, and accreditation readiness.

§  Support and advise on interactions with government regulators, enforcement agencies, CMS contractors, and accrediting organizations, as directed by the General Counsel.

§  Support legal due diligence for potential acquisitions and other strategic transactions, as needed.

§  Develop and maintain a strong understanding of the organization’s business, markets, customers, and competitive landscape to provide practical, riskbased legal guidance.

§  Build and maintain effective working relationships with business leaders to encourage proactive engagement with inhouse legal counsel.

§  Collaborate effectively within the Legal department and support crossfunctional initiatives and special projects, as assigned.

§  Utilize Numotion Leadership Principles to perform the job with integrity, compliance, and values consistent with Numotion’s mission.

§  Adhere to employee or customer confidentiality and comply with Numotion’s policies and federal regulations.

§  Always provide excellent customer service for all internal and external customers of the operations.  Provide solutions for customer concerns and continually focus on customer service as our top priority.

REQUIRED QUALIFICATIONS, SKILLS, AND EXPERIENCE:

§  Juris Doctor (JD) degree from an accredited law school.

§  Active license to practice law in at least one U.S. jurisdiction, with ability to obtain licensure in additional jurisdictions as required.

§  6–8+ years of experience with healthcare legal/compliance issues, preferably in-house or at a reputable law firm.

§  Working knowledge of healthcare regulatory frameworks applicable to DMEPOS and related healthcare services (including, as applicable, Medicare/Medicaid requirements, accreditation standards, payer audits, and fraud and abuse considerations).

§  Experience supporting internal investigations, audits, and compliance remediation.

§  Strong drafting and negotiation skills for commercial agreements and vendor/customer contracts.

§  Demonstrated ability to manage matters independently with appropriate escalation.

§  Excellent communication skills, including the ability to translate legal requirements into practical guidance for business partners.

§  Strong organizational skills and attention to detail; ability to manage multiple priorities in a fast-paced environment.

§  High integrity, sound judgment, and a collaborative, service-oriented mindset.

 

Preferred COMPETENCIES AND SKILLS:

§  Prior inhouse legal experience within a healthcare services, medical device, or other highly regulated organization

§  Experience supporting or partnering closely with corporate compliance programs, including remediation efforts

§  Experience advising multientity or growthoriented businesses, including subsidiary or adjacency operations

§  Experience supporting licensing, accreditation, enrollment, and changeofownership matters

§  Experience conducting or supporting legal due diligence for acquisitions or strategic transactions

§  Demonstrated leadership and influencing skills, with the ability to build strong crossfunctional relationships and partner effectively with senior leaders

§  Must be able to perform bending, twisting, stooping, and reaching, and lifting of equipment weighing up to 20 pounds.
