Important Legal Information And Data Protection

The information you provide will be added to Tungsten Automation's Applicant Registration Database to create an ID and password so you can create a job application to Tungsten Automation (15211 Laguna Canyon Rd. Irvine, CA United States) or one of its affiliates (together, Tungsten Automation group), and in the event further action is taken in relation to your job application, your information will subsequently be transferred to Tungsten Automation's New Hire Onboarding system. Such information will be accessed by the technical staff maintaining or managing access and registration rights. If you decide not to register you will not be able to use this tool to submit or manage your employment application. If you are applying to a particular job opening, the data controller/holder of your application information is your potential employer in the Tungsten Automation group and your information will be protected in accordance with local law applicable to your potential employer. If you are submitting your application for any open current or future positions, the holder of your information will be Tungsten Automation, Inc. until your information is submitted to your potential employer for a particular opening. Please note that Tungsten Automation, Inc. is a US Corporation and while being the data holder of your information it will be protected in accordance with US Laws. By registering, you acknowledge and approve that your registration information may be processed by any affiliate within Tungsten Automation group for the purpose of evaluating your application for employment and performing any related activities. By registering, you also acknowledge and approve that your registration information may be stored and processed on the data controller's/ holder's servers or the servers of the authorized Tungsten Automation group or third party service providers anywhere in the world. If your information holder is a potential employer in the Tungsten Automation group, for the purpose of evaluating your application for employment and performing any related activities, by registering you also acknowledge and approve that your registration information may be transferred from the country where the potential employer is located to any other country where other affiliates of Tungsten Automation group are located and that such transfer may take place even when the target country's legislation does not provide the equivalent level of personal data protection as that in force in the country where the potential employer is located. You are further advised that, depending on your jurisdiction and in accordance with applicable law, your ID and password will be deleted either six months or twelve months from the time your application process concludes or the last time you had access to this tool.

 

By accepting these terms and continuing on with the application registration process, you certify that the information you provide is accurate to the best of your knowledge and belief, and that you consent to Tungsten Automation confirmation of the details.

Who are we?

Tungsten Automation Inc. and its affiliates (collectively "Tungsten Automation", "we" or "us", and where relevant your potential employer in the Tungsten Automation group) is the data controller of any information you submit in support of your application. This means that we are responsible for deciding how we hold and use personal data about you. We are required under data protection legislation to notify you of the information contained in this privacy notice.

 

Purpose of this notice

This notice tells you how we use data you submit when you apply for a job or submit an application to us for recruitment purposes.

 

It also tells you how you can exercise your rights (including the right to object to some of the data handling we carry out). More information about your rights and how you can exercise them is set out in the "Your Rights" section below.

 

How do we use your information?

We use information you supply in support of your application so that we can consider your application, assess your suitability, and conduct eligibility checks where necessary and to the extent permitted by law and for equal opportunities purposes.

We use your data for the purpose of our legitimate interests in managing our recruitment and so that we can take steps at your request prior to entering into a contract. If a position that is, or may be, of interest to you requires background checks, we will tell you about this.

Where necessary, we will also use this data for the purpose of our legitimate interests in accessing appropriate professional advice and in order to ensure we comply with legal obligations to which our business is subject.

When you apply for a position with us or submit information in support of your application, we will tell you whether the information we are requesting is essential so that we can progress your application or whether the supply of this information is optional.

 

With the exception of personal data which we collect and use for the purpose of entering into a contract with you, you can object to our use of the data you have provided at any time.

 

How long do we keep this information for?

We usually retain information supplied by job applicants for the time required for the recruitment process/decision and, thereafter, if applicable for another position that may arise within the Tungsten Automation group in the future.

 

If your application is successful, relevant information will be used for the purpose of administrating your subsequent employment and will be retained and used in accordance with our Employee Privacy Notice (a copy of which will be provided when you take up your employment).

 

Who do we share this information with?

Where necessary so that we can manage our recruitment process, we will share your information with other Tungsten Automation group entities (HR team/(line) managers/employees that is responsible for the open position you applied for) our service providers and professional advisers (e.g. recruitment agencies, providers who carry out background checks on our behalf, and, if applicable to the role you are applying for, suppliers who run candidate assessment programmes for us; email hosting provider).

If we have a reasonable interest in verifying the data you have provided (e.g. if there are indications that they are incorrect) and we have no other means to check this, we may also contact third parties whose details you have supplied for that purpose so that we can verify information you have supplied in relation to your previous employment and qualifications.

Otherwise we may share your information with further third parties if:

 

  • we are required to do so by law;
  • we have permissions to do so;
  • this is necessary so that we can enforce our terms of use, rights or property or the rights or property of any third party; or
  • this is necessary in connection with the sale of our business or its assets (in which case your details will be disclosed to our advisers and any prospective purchaser’s advisers and will be passed to the new owners).

 

Where do we transfer this information to?

Some of the information you send us in support of your employment application may be shared with other Tungsten Automation affiliates (see list at https://www.tungstenautomation.com/contact-us/offices) or service providers outside of the European Economic Area ("EEA") as required to process your application. These countries may include, among others, the countries in which we have operations and the countries where our service providers are located or have data centres, such as the United States. We use a New Hire Onboarding system which is hosted in the US.

 

To secure such transfer of your data, we rely on various additional data protection measures such as adequacy decisions of the European Commission (read more here), Standard Contractual Clauses (read more here), Privacy Shield certification (read more here), and the Binding Corporate Rules that some of our suppliers have adopted (read more here). Your Rights

You have the right to ask us at any time for a copy of your personal data. In relation to personal data you supply to us electronically, and which is held by us for the purpose of entering into a contract between us or on the basis of your consent, you are entitled to ask us for a copy of this information in a structured, commonly used and machine readable format so that you can reuse it or share it with other organisations.

If you think the personal data we hold about you is inaccurate or incomplete, you can ask us to correct it or complete it.

In some circumstances you also have the right to object to our processing of your data and can ask us to restrict our use of your data and to delete it.

If we ask for your consent so that we can use your data for a particular purpose, we will remind you that you are free to withdraw your consent at any time and we will tell you how you can do this.

There are some exceptions to these rights, however. For example, it will not be possible for us to delete your data if we are required by law to keep it or if we hold it in connection with a contract with you. Similarly, access to your data may be refused if making the information available would reveal personal information about another person or if we are legally prevented from disclosing such information.
